TERMS AND CONDITIONS FOR SOCIAL BITE FUND’S WEE SLEEP OUT

“Affiliated Partners” means:

- The Social Bite Ltd, a registered company in Scotland with company registration number SC424001 and with registered address 1 Leith Walk, Edinburgh EH6 8LN;
- Virgin Money Giving Limited, a company registered in England and Wales with company number 02733492 and with its registered office at Jubilee House, Gosforth, Newcastle-Upon-Tyne, NE3 4PL;
- Sponsors & Supporters, organisations who have funded portions of the running costs of Wee Sleep Out are Wee Sleep Out’s “Sponsors”; organisations who have provided advice and support to Wee Sleep Out are “Supporters”. A full list of these is available here. 


“Donations” means the donations raised by the relevant WSO Event hosted by You.

“Wee Sleep Out” is an outreach programme run by SBF.

“SBF/We/Us/Our” means Social Bite Fund, which is the registered charity with registration number SC045232 and with registered office at 1 Leith Walk, Edinburgh EH6 8LN.

“WSO Event” means a Wee Sleep Out event organised and hosted by You.

“You/Your” means the person agreeing to be bound by these terms and conditions and who is registering to host a WSO Event.


1.YOUR OBLIGATIONS

1.1 You agree that:

1.1.1 You will comply with and, if You are enrolling in a WSO Event on behalf of an organisation, You will ensure that the organisation complies with all applicable laws and regulations including all relevant Health and Safety laws and regulations;

1.1.2 You will ensure that all participants at a WSO Event hosted by You comply with all applicable laws and regulations;

1.1.3 You will ensure that if You are enrolling in WSO Event on behalf of an organisation that the organisation has in place all necessary insurances, up-to-date Child Protection Policies, Health and Safety Policies and You agree to adhere to all aspects of those policies. Where requested by Us, You will provide Us with evidence of these policies and of Your compliance with them;

1.1.4 You must remain contactable by Us on the phone number and email address provided in the relevant WSO Event registration form, both in the lead up to the WSO Event and for the duration of the WSO Event;

1.1.5 You must obtain all relevant consents from participants and, where participants are children, from their legal parent/guardian (where required under applicable laws) including: (a) permission to attend the event; and (b) any relevant photography or filming consents;

1.1.6 You will ensure that all personal data relating to participants (and/or their legal parent/guardian) is kept and managed in accordance with all applicable data protection laws;

1.1.7 You hold valid up to date, legal documentation (including all necessary registrations, approvals or clearances) required to work with young people in Scotland and the area in which You intend to host Your WSO Event. In the event that there are any significant changes to this legal documentation, You will notify Us without undue delay;

1.1.8 You are recognised and trusted by the parents and/or guardians of the young people You work with;

1.1.9 You are solely responsible for Your actions and take full responsibility for the WSO Event You are hosting and agree that SBF is not responsible for any injury or illness that You or any participants may suffer as a result of Your/their participation in the WSO Event hosted by You;

1.1.10 You indemnify and hold harmless Us, Our officers, employees, agents, representatives and Our Affiliated Partners from all liabilities, claims, actions and/or damages arising out of or in any way in connection with Your hosting of and/or participation in a WSO Event; and

1.1.11 to the fullest extent permitted by law, You hereby waive, release and forever discharge Us, Our officers, employees, agents, representatives and Affiliated Partners for all liabilities claims, actions or damages that You may have against Us arising out of or in any way in connection with Your hosting of and/or participation in a WSO Event.

2.PARTICIPATION/HOSTING

2.1 You acknowledge that participation in and hosting a WSO Event is done so at Your own risk.

2.2 You shall not be entitled to be a lead organiser of a WSO Event unless You are aged eighteen (18) by 30 November 2019.

3.PUBLICITY AND DATA PROTECTION

3.1 You agree that any photography or filming of you or participants at the WSO Event hosted by you that is either (i) shared with Us; or (ii) available in the public domain (for example, through publication on social media) can be used for promotional purposes by Us.

3.2 We will take all reasonable steps to ensure that any personal data provided by You to Us is processed in line with our Privacy Policy.

3.3 You agree to inform Us of any changes to the information supplied in Your WSO Event registration form as soon as such changes occur.

4.DONATIONS

4.1 We will ensure that the Donations made by You are utilised by SBF in their charitable work helping rough sleepers and people suffering from homelessness in Scotland.

4.2 If, for any reason, We advise You to cancel the WSO Event You are hosting, or You otherwise decide to cancel Your WSO Event, all Donations already received are non-refundable and will be distributed to SBF as set out in paragraph 4.1.

5.OTHER

5.1 These terms and conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales. 

5.2 If there are any inconsistencies between these Terms and Conditions and the registration form to sign up to host a WSO Event, these Terms and Conditions will prevail.

5.3 These terms and conditions apply to the extent they are lawful under applicable laws. If any court or relevant authority decides that any of the paragraphs are unlawful, the remaining paragraphs will remain in full force and effect.
